Operating a short-term let without the required licence is a criminal offence under the Civic Government (Scotland) Act 1982.
West Lothian Council does not have powers to take direct action against unlicensed properties.
Responsibility for investigating and enforcing against unlicensed short-term lets lies with Police Scotland, who can refer cases to the Procurator Fiscal.
The Council will:
record complaints about suspected unlicensed properties,
share information with Police Scotland and other relevant services,
ensure that compliance is checked if a licence application is made for that property in the future, and
If you believe a property is operating as an unlicensed short-term let, please report it to Police Scotland in the first instance. You may also notify the Council so the information can be logged and passed to our partners. You can use this form to notify us of any suspected Short Term Lets operating without a licence.
