Information to homeowners regarding BBC Watchdog programme
West Lothian Council are aware of the public concern following the issues raised in the BBC Watchdog programme on new build housing on 01 May 2019.
The council would recommend any concerned homeowners contact the developer who built their property.
Responsibility for ensuring a completed building meets building regulations lies with the relevant person in these cases the developer, not the Council.
In instances whereby there is an alleged dispute between a private housebuilder and a private owner it is regarded as a building quality issue and the housebuilder is expected to engage with the private owner to rectify any alleged build quality issues.
The housebuilder is required to certify all the completed work as being in accordance with the approved plans, details and building regulations by the submission of a Completion Certificate.
In signing the Completion Certificate the relevant person (Bellway Homes) is declaring that any work has been carried out in accordance with the approved building warrant plans and is also confirming that the completed works comply with building regulations. The council receives the signed Completion Certificate from the housebuilder.
We would stress again that the responsibility for ensuring a completed building meets the building regulations lies with the relevant person/developer. It is incumbent on the private developer to engage with the private owner to rectify any alleged issues regarding the quality of build.
We will continue to engage with the developers in West Lothian to ensure that they are taking all necessary steps to meet their obligations in terms of building regulations and that they engage with any concerned homeowners as quickly as possible.
