Information on Interviews under caution
What happens when you are asked to attend an interview under caution?
We will send a letter requesting that you attend an interview under caution at an appointed time and place. We will conduct the interview professionally and you will always be advised of your rights. You may wish to consider seeking advice before the interview from a solicitor or Citizens Advice Bureau or similar organisation. Alternatively you may wish a friend, relative or advisor to be present during the interview, however it is important to note that they will not be involved in the interview and will have no right to interfere or to ask questions during the interview.
What happens at the interview?
The purpose of the interview is to establish the facts relating to the suspected offence. An interview under caution forms part of our investigation process.
What happens after the interview?
We will use the facts established at the interview and any other relevant evidence to decide how we will take the investigation forward.
The following information is guidance as to the possible outcome of the investigation.
There are 4 possible outcomes;
- No Further Action - If we are satisfied that no offence has been committed then no further action will be taken. Even those cases where evidence exists but the Council does not feel it is in the public interest to take further action, we will write to advise you of this.
- Administrative Caution - An administrative caution will only be offered in certain circumstances as an alternative to prosecution, Click here for further information about this. If you decide not to accept the administrative caution we will refer your case to the Procurator Fiscal.
- Administrative Penalty - An administrative penalty will only be offered in certain circumstances as an alternative to prosecution, Click here for further information about this. If you decide not to accept the administrative penalty we will refer your case to the Procurator Fiscal.
- Prosecution - Where we consider the offence to be particularly serious, or if you refuse an administrative caution/penalty, we will refer the case to the Procurator Fiscal.
- Overpayments - If an overpayment of benefit has arisen you will be liable to repay this whether or not an offence has been committed.
